Incorrectly declared CGT is one of Pakistan’s top FBR notice triggers. Don’t guess — WhatsApp FirsTax and get it right the first time.

WHAT IS CAPITAL GAINS TAX?

CGT Applies When You Sell Property — the Rate Depends on How Long You Held It

Capital Gains Tax (CGT) is levied on the profit (gain) you make when selling immovable property in Pakistan. The tax rate decreases the longer you hold the property — rewarding long-term investment. The gain is calculated as the sale price minus the purchase price (or FBR’s DC value, whichever is higher).

FILER vs NON-FILER — CGT ADVANCE TAX

In addition to CGT on the gain, property sellers also pay advance tax at the time of transfer. Filers (ATL) pay 3% advance tax on sale value. Non-filers pay 6%. On a PKR 1 crore property — this is a PKR 30,000 vs PKR 60,000 difference from advance tax alone.

THE FBR DC VALUE TRAP — MOST PEOPLE GET THIS WRONG

FBR Uses DC Value — Not Your Actual Sale Price — for CGT Calculation

FBR publishes its own property valuation tables — called DC values — for every area in Pakistan. For CGT calculation, FBR uses the higher of your actual sale price or the FBR DC value. This means even if you sell below market value, or if the buyer understates the price on the deed, CGT is calculated on the DC value if it’s higher — and if you declare less, FBR notices will follow.

CAPITAL GAINS TAX FAQs

Everything About CGT on Property in Pakistan

Capital Gains Tax (CGT) is a tax on the profit (gain) made from selling immovable property — plots, houses, apartments, or commercial units. The gain is the difference between the sale price and purchase price (or FBR’s DC value, whichever is higher). The rate decreases the longer you hold the property — from 15% for properties sold within 1 year, down to 0% for open plots held more than 4 years.
For open plots (unbuilt land) held for more than 4 years, the CGT rate is 0%. However, you must still declare the sale in your annual income tax return and wealth statement — a zero-rate gain still needs to be reported. FirsTax files this correctly so no FBR notice follows.
FBR’s DC (District Collector) value is FBR’s official property valuation by area and size. For CGT calculation, FBR uses the higher of your actual sale/purchase price or the DC value. If you declare below the DC value — or your deed reflects a lower amount — FBR will issue a notice. FirsTax uses current DC valuation tables to ensure correct calculation.
Yes. Property sales must be declared in an annual income tax return regardless of whether you have other income. The return includes the capital gains calculation and an updated wealth statement removing the property and adding the sale proceeds. Failure to file is one of the most common FBR notice triggers.
At the time of property registration/transfer, the sub-registrar collects advance tax from both buyer and seller. For sellers on ATL (filers), the advance tax rate is 3% of the higher of sale value or DC value. For non-filers, it is 6%. This advance tax is credited against the CGT liability when you file your annual return. FirsTax reconciles this correctly in your return.
Very likely yes. FBR receives property transfer data from sub-registrars and NADRA. If the property sale appears in FBR’s system but you haven’t filed a return declaring it, a Section 114 notice will follow. WhatsApp FirsTax immediately — we can file the return and in many cases resolve the situation before penalties escalate.
